In our blog post last week, we discussed green card renewal. One thing our Texas readers should keep in mind is that the procedures for renewing a green card aren't the same for people who have a conditional permanent resident status. The conditional cards can't be renewed. Instead, the conditions placed on the permanent resident status have to be removed. If the conditions aren't removed, the person loses their permanent resident status.

What Is a Conditional Permanent Resident Green Card?

A conditional permanent resident green card is valid for two years. During that time, the person must meet the condition of the green card.

When Do I Need To File the Petition To Remove the Condition?

They must file a petition to remove the condition in the 90 days preceding the expiration of the green card. In order to do this, the person must fill out the appropriate form.

What Forms Do I Need To Fill Out To Remove the Conditions?

There are two forms that are used to remove conditions. Which one you use depends on which condition you have. If you have a green card for entrepreneurs, you would have to file Form I-829, Petition by Entrepreneur to Remove Conditions. If you have a green card that is based on marriage, Form I-751, Petition to Remove the Conditions of Residence must be filed.

Making sure you have everything in order when filing petitions is vital. One way to do this is to have someone familiar with the process to help you as you go through the process.
